Booking Terms and Conditions

These Booking Terms and Conditions apply to direct reservations for Quesada Dream Villa in Ciudad Quesada, Alicante, Spain.

Please read them carefully before making a booking. By paying a deposit or the full booking price, the lead guest confirms that they have read and accepted these terms on behalf of everyone included in the booking.

1. The Booking Contract

Your booking contract is with:

A booking is not confirmed until:

  • We have accepted your booking request;
  • We have received the required deposit or full payment; and
  • We have sent you written confirmation.

Provisional enquiries do not reserve the property unless we expressly confirm otherwise.

If you book through Vrbo or another booking platform, that platform’s terms may also apply. If there is a conflict, the terms supplied through the platform will normally apply to that platform booking.

2. Lead Guest

The person making the booking must be at least [MINIMUM AGE] years old and must have the authority to accept these terms on behalf of all guests.

The lead guest is responsible for:

  • Making all payments connected with the booking;
  • Providing accurate information;
  • Sharing these terms and the Property Rules with the other guests;
  • Ensuring that everyone in the group behaves responsibly; and
  • Paying for damage or additional costs caused by any member of the group, where legally recoverable.

We must be given the full names and other required details of everyone staying at the villa.

3. Occupancy

The villa accommodates a maximum of [MAXIMUM NUMBER] guests.

Only the people included in the confirmed booking may stay overnight. The villa must not be occupied by more than the stated maximum unless we have given written permission in advance.

Bookings must not be transferred or resold, and the property must not be sublet.

4. Prices

The total price of your stay will be shown in your booking confirmation.

Unless otherwise stated, the price includes:

  • Use of the villa for the confirmed guests;
  • Private use of the swimming pool;
  • Electricity and water within reasonable domestic use;
  • Bed linen and towels;
  • Standard cleaning before arrival; and
  • Any other services specifically listed in the booking confirmation.

Flights, airport transfers, travel insurance and personal expenses are not included unless expressly stated.

Any optional charges or additional services will be explained before you agree to them.

5. Deposit and Payment

A booking deposit of [£/€ AMOUNT OR PERCENTAGE] is required to secure your reservation.

The remaining balance must be paid no later than [NUMBER] weeks before arrival.

If the booking is made within [NUMBER] weeks of arrival, the full price must be paid when the booking is confirmed.

Payment should be made using the method specified in your booking confirmation. The guest is responsible for any bank, currency-conversion or international-transfer charges.

If the balance is not received by the due date, we will contact you and allow a reasonable opportunity to make payment. If payment remains outstanding, we may treat the booking as cancelled by you and apply the cancellation terms below.

6. Security Deposit

A refundable security deposit of [£/€ AMOUNT] may be required before arrival.

The security deposit may be used towards reasonable costs arising from:

  • Damage to the villa, pool, furniture or equipment;
  • Missing items or lost keys;
  • Excessive or unauthorised cleaning;
  • Smoking inside the property;
  • Unauthorised guests, pets, parties or events; or
  • Other serious breaches of these terms or the Property Rules.

The deposit will normally be returned within [NUMBER] days after departure, less any reasonable deductions.

If a deduction is necessary, we will provide an explanation and, where reasonably available, supporting evidence. The guest remains responsible for losses exceeding the security deposit where those losses were caused by the guest or their party.

7. Cancellation by the Guest

Cancellations must be sent to us in writing by email. The cancellation takes effect when we receive it.

Cancellation charges will not exceed the loss reasonably resulting from the cancellation. If we rebook the cancelled dates, we will take the replacement income and any costs saved into account when calculating the final amount retained.

Where a refund is due, it will normally be made using the original payment method within [NUMBER] days.

Holiday accommodation booked for specific dates is generally not covered by the standard 14-day cooling-off period.

8. Changes Requested by the Guest

If you wish to change your dates, guest details or any other part of the booking, please contact us as soon as possible.

We will try to accommodate reasonable requests but cannot guarantee that a change will be possible. A change may be subject to:

  • Availability;
  • Any difference in the booking price;
  • Reasonable administrative or third-party costs; and
  • Written confirmation from us.

A change is not valid until it has been confirmed in writing.

9. Cancellation or Significant Changes by the Owner

We will make every reasonable effort to provide the villa as booked. Occasionally, circumstances outside our reasonable control may make this impossible.

If we have to cancel your booking before arrival, we will notify you as soon as reasonably possible and offer:

  • Alternative dates, subject to availability; or
  • A refund of the accommodation payments made to us.

You will not be required to accept alternative dates.

We will not cancel a confirmed booking merely to accept another booking at a higher price.

Our responsibility for additional losses will depend upon why the cancellation occurred and the rights available to you under applicable law. Nothing in these terms limits rights that cannot legally be excluded.

10. Circumstances Beyond Our Control

Neither party will be responsible for a failure or delay caused by an extraordinary event that could not reasonably have been avoided or controlled.

Such events may include severe weather, wildfire, flood, natural disaster, widespread utility failure, epidemic, government restriction, civil disturbance or other serious emergency.

If such an event affects your booking, please contact us promptly. We will discuss the available options and deal with any refund or cancellation in accordance with applicable consumer law and the circumstances at the time.

Problems with flights, ferries, passports, visas or personal travel arrangements do not automatically entitle the guest to a refund of the accommodation price. Comprehensive travel insurance is strongly recommended.

11. Travel Insurance

Guests are strongly advised to arrange suitable travel insurance as soon as the booking is confirmed.

Your policy should provide appropriate cover for cancellation, illness, medical treatment, travel disruption, lost belongings and other risks relevant to your journey and stay.

12. Arrival and Departure

Check-in is from [CHECK-IN TIME] and check-out is by [CHECK-OUT TIME], unless a different arrangement has been confirmed in writing.

Please do not arrive early or leave late without prior agreement. Access instructions will be supplied before arrival once the booking has been paid for and all required guest information has been received.

The lead guest is responsible for keeping keys and access details secure. Lost keys or emergency lock replacement may incur a reasonable charge.

13. Spanish Guest Registration

Spanish law requires providers of holiday accommodation to collect and submit specified information about their guests.

All guests must provide the information and identification details required for registration before or upon arrival. Entry forms may need to be signed by guests aged 14 or over, with information about younger children supplied by the accompanying adult.

We may be unable to provide access to the villa if the legally required information is not supplied.

Guest information will be handled in accordance with our Privacy Policy.

14. Property Rules

Guests must follow the Property Rules published on this website and any reasonable safety or community instructions provided during the stay.

In particular:

  • The villa must not be used for parties, events or commercial activity.
  • Smoking and vaping are not permitted inside.
  • Pets are not permitted unless agreed in writing before booking.
  • Guests must avoid excessive noise and respect neighbouring residents.
  • Children must be supervised, particularly around the swimming pool.
  • Glass must not be taken into the pool area.
  • Air conditioning and utilities must be used responsibly.
  • Illegal, dangerous or antisocial activity is prohibited.

A serious breach may result in the booking being terminated and guests being required to leave. Any cancellation charge or deduction will be limited to losses and costs that can reasonably and lawfully be recovered.

15. Swimming Pool and Guest Safety

Guests use the swimming pool and outdoor areas responsibly and must follow all safety instructions.

Children and anyone unable to swim confidently must be supervised by a responsible adult at all times. Guests must not run, dive, take glass into the pool area or use the pool while excessively affected by alcohol or medication.

The lead guest is responsible for assessing whether the villa is suitable for the needs and abilities of their party.

Nothing in these terms excludes or limits responsibility where it would be unlawful to do so, including responsibility for death or personal injury caused by proven negligence.

16. Damage, Breakages and Problems

Please treat the villa and its contents with reasonable care.

Accidental damage, missing items, defects or maintenance problems must be reported as soon as possible. Reporting a problem promptly gives us an opportunity to resolve it and may prevent further damage.

Guests must not arrange or attempt repairs without permission, except where immediate action is reasonably necessary to prevent injury or serious additional damage.

Guests may be charged the reasonable cost of repairing damage or replacing items where the loss was caused deliberately, carelessly or through a breach of these terms.

Normal wear and tear will not be charged.

17. Cleaning and Condition on Departure

The villa will be prepared for your arrival and should be left in a reasonably tidy condition.

Before departure, guests should:

  • Wash and put away used crockery and cooking utensils;
  • Remove unwanted food;
  • Place rubbish in the appropriate local bins;
  • Return furniture and equipment to their original positions; and
  • Follow the supplied departure instructions.

The standard cleaning charge does not cover excessive mess, smoking, staining, unauthorised pets or cleaning required following misuse of the property.

18. Maintenance and Access

We respect your privacy during your stay.

The owner, property manager or authorised contractor may need to enter the villa at a reasonable time to carry out urgent repairs, maintenance, safety checks or work necessary to protect the property.

Except in an emergency, we will try to give reasonable notice and minimise disruption.

Routine pool and garden maintenance may take place during a stay.

19. Descriptions and Availability

We take reasonable care to ensure that website descriptions, photographs and facilities are accurate.

Minor differences may arise due to maintenance, replacement items, seasonal conditions or improvements. These will not normally constitute a significant change to the booking.

If an important advertised facility becomes unavailable, please notify us. We will take reasonable steps to resolve the problem and, where appropriate, consider a proportionate remedy.

20. Complaints During Your Stay

If you experience a problem, please contact us or our local representative as soon as possible using the details supplied with your booking.

We must be given a reasonable opportunity to investigate and resolve the issue during your stay. If the matter is not resolved, please send a written complaint within [NUMBER] days after departure, including relevant details and photographs where appropriate.

This does not affect any statutory rights or legal time limits that apply to you.

21. Liability

We are responsible for providing the accommodation with reasonable care and skill and in accordance with the confirmed booking.

We are not responsible for losses that:

  • Could not reasonably have been anticipated when the booking was made;
  • Result from the guest’s own act, omission or breach of these terms;
  • Relate to business activity, loss of profit or commercial use of the villa; or
  • Are caused solely by an independent travel provider or other third party for whom we are not legally responsible.

Nothing in these terms excludes or restricts liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot legally be excluded.

22. Personal Belongings

Guests are responsible for their passports, money, vehicles and personal belongings.

Please lock the villa when leaving it and use any security facilities provided. We are not responsible for loss, theft or damage unless it results from a failure for which we are legally responsible.

Any belongings left after departure may be stored for a reasonable period. The guest will be responsible for postage or courier costs if they ask for an item to be returned.

23. Privacy

Personal information supplied in connection with an enquiry or booking will be handled in accordance with our Privacy Policy.

Information may also be collected and reported where required by Spanish guest-registration legislation.

24. Governing Law

These terms and the booking contract are governed by the laws that apply to the provision of the accommodation in Spain.

If you are booking as a consumer, nothing in this section deprives you of any mandatory protections or rights available under the laws of the country in which you normally live.

We encourage both parties to try to resolve any dispute informally before beginning legal proceedings.

25. General Terms

If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

A delay in enforcing a right does not mean that the right has been waived.

No person other than the owner and the named guests has any right to enforce the booking contract, except where applicable law provides otherwise.

These terms, the booking confirmation, the Property Rules and any expressly agreed written arrangements form the agreement between the owner and the guest.
